MASTERING THE MIX LTD SOFTWARE LICENSE AGREEMENT

End User License Agreement (EULA)

Please Read Carefully: Before clicking the "accept" button or using our software, please read these terms and conditions carefully. By clicking "accept", downloading, installing, or using our licensed software and any included technology, ideas, data, algorithms, or information (collectively, "the Software"), you are forming a binding agreement with MASTERING THE MIX LTD ("MASTERING THE MIX"). This agreement outlines your legal rights and obligations regarding the use of the Software.

Acceptance

By using the Software, you affirm that you have the legal capacity and authority to enter into this Agreement. You agree to use the Software in compliance with these terms and all applicable laws. If you are using the Software on behalf of an organization, you confirm that you are authorized to bind your organization to these terms.

License Grant

MASTERING THE MIX grants you a non-exclusive, non-transferable license to use the Software, along with any associated presets and documentation (available in printed, online, or electronic formats), on two standalone computers or networked devices at any time. If the Software will be used concurrently by multiple users, additional licenses are required. The Software is considered "in use" when it is loaded into the device's memory (RAM). This license also applies to any upgrades of the Software, provided you have a valid license for the original Software. Receiving the Software in multiple formats does not provide additional licenses.

Ownership

All intellectual property rights in the Software and documentation, including any related images, photographs, animations, videos, audio, music, and text, are owned by MASTERING THE MIX or its suppliers. These rights are protected by UK and international copyright, patent laws, and treaty provisions. No rights are granted beyond those explicitly stated in this Agreement.

Usage Restrictions

You may not modify, adapt, decompile, disassemble, or reverse engineer the Software, except as permitted by law. You may not create derivative works from the Software.

Limited Warranty

MASTERING THE MIX warrants that the Software will substantially perform as described in the user documentation for 30 days from download. This warranty does not apply if the Software fails due to misuse, unauthorized modifications, or accidents. This limited warranty is your exclusive remedy and is provided in lieu of all other warranties, express or implied.

Remedies

If the Software does not conform to the warranty, MASTERING THE MIX will, at its option, either refund the purchase price or repair or replace the Software. This remedy is available only if the Software is returned with all media and documentation, along with proof of purchase, during the warranty period.

Standards Conformance

The Software is designed to conform to industry standards for audio processing. While MASTERING THE MIX strives for accuracy, it does not guarantee that the Software will always perfectly comply with current or future standards.

Support

Provided you comply with this Agreement, MASTERING THE MIX offers email support for the Software for 12 months from the purchase date to the original purchaser.

Data Collection

Upon activation, MASTERING THE MIX may collect your IP address and contact information to facilitate updates and support. This information is not used for marketing unless explicitly agreed upon. No financial data is collected.

Usage Information

MASTERING THE MIX may collect non-personal data from your computer to verify software authorization.

Disclaimer

The Software is provided "as is," without any warranties except those described herein. MASTERING THE MIX disclaims all other warranties, including the implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

In no event will MASTERING THE MIX's liability exceed the amount paid for the Software license. MASTERING THE MIX is not liable for indirect damages or losses, except as required by law.

Termination

This Agreement will automatically terminate if you fail to comply with its terms. Upon termination, you must cease all use and destroy all copies of the Software.

General Provisions

This Agreement is the complete and exclusive agreement between you and MASTERING THE MIX. It is governed by the laws of England and Wales. Disputes must be resolved within one year of their occurrence and without a jury trial. Class action lawsuits against MASTERING THE MIX are not permitted.
